Terms of Service

Welcome to HomEvo! These Terms of Service ("Terms") govern your access to and use of the HomEvo mobile application and related services (collectively, the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
1. Acceptance of Terms
By creating an account, accessing, or using the HomEvo App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and HomEvo ("we", "us", or "our").
2. Definitions
- Customer: An individual or entity using the App to request and book services.
- Service Partner: An individual or entity registered with HomEvo to provide services to Customers through the App.
- Services: The home-related or general services offered and facilitated through the App (e.g., plumbing, electrical, cleaning, carpentry).
- Content: Any text, graphics, images, music, software, audio, video, information, or other materials generated, provided, or otherwise made available through the App.
3. Eligibility
You must be capable of forming a binding contract to use the App. By using the App, you represent and warrant that you meet these eligibility requirements. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
4. Account Registration and Security
- Account Creation: To access certain features of the App, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Account Responsibility: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your password or account. HomEvo cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.
5. Use of the App
- Customers: You may use the App to browse, book, manage, and pay for Services offered by Service Partners. You agree to provide accurate information regarding your service requests and to make timely payments for Services rendered.
- Service Partners: You may use the App to list your Services, accept booking requests, communicate with Customers, and receive payments for Services rendered. You agree to provide Services with professionalism, skill, and in accordance with all applicable laws and regulations.
- Prohibited Conduct: You agree not to:
- Use the App for any unlawful purpose or in any way that violates these Terms.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Interfere with or disrupt the operation of the App or the servers or networks connected to the App.
- Attempt to gain unauthorized access to any portion or feature of the App, or any other systems or networks connected to the App.
- Engage in any form of harassment, discrimination, or abusive behavior towards other users or Service Partners.
- Post or transmit any Content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or otherwise illegal.
6. Booking and Payment
- Booking Confirmation: All bookings are subject to confirmation by the Service Partner. HomEvo facilitates the booking process but does not guarantee the availability of any Service Partner or the completion of any Service.
- Payment Terms: Payments for Services are processed securely through Razorpay. You agree to pay all fees and charges associated with your bookings in a timely manner. HomEvo may charge a service fee for facilitating bookings.
- Cancellations and Refunds: Cancellation and refund policies will be clearly communicated within the App for each service or booking. You agree to abide by these policies.
- Disputes: Any disputes regarding payments or Services should first be attempted to be resolved directly between the Customer and Service Partner. HomEvo may, at its sole discretion, offer mediation or support in resolving disputes, but is not obligated to do so.
7. Ratings and Reviews
Customers may be able to rate and review Service Partners, and vice-versa. You agree that any ratings or reviews you provide will be accurate, truthful, and based on your actual experience. HomEvo reserves the right to remove any content that violates these Terms or is deemed inappropriate.
8. Intellectual Property
All Content and materials available on the App, including but not limited to text, graphics, logos, icons, images, and software, are the property of HomEvo or its licensors and are protected by intellectual property laws. You may not use, reproduce, distribute, or create derivative works from any Content without our express written permission.
9. Disclaimers
- "As Is" Basis: The App and Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
- No Endorsement of Service Partners: HomEvo does not endorse any Service Partner. While we may perform background checks or verify certain credentials, we do not guarantee the quality, suitability, or safety of any Service Partner or the Services they provide. You acknowledge that you use Service Partners at your own risk.
- No Warranty of Service Quality: HomEvo does not warrant that the Services will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
10. Limitation of Liability
To the maximum extent permitted by applicable law, HomEvo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App or Services; (b) any conduct or Content of any third party on the App; (c) any Content obtained from the App; and (d) unauthorized access, use, or alteration of your transmissions or Content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not HomEvo has been informed of the possibility of such damage.
11. Indemnification
You agree to indemnify, defend, and hold harmless HomEvo, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the court located in Baripada, Odisha.
13. Changes to Terms
We reserve the right to modify or update these Terms at any time, at our sole discretion. If we make material changes, we will notify you through the App or by email. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
14. Termination
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
